As mentioned in a previous newsletter, the recent findings from the District Court in respect of ‘accidental’ damage and the Osaki case. It is always good to be reminded that ‘accidental’ damage by the tenant to the property they are in, (which is what the Osaki case was eventually found to be), is not the responsibility of the tenant to make good or even pay an excess for. You may want to check your current insurance policies to see if you are covered for accidental damage. If not, have a talk with your provider to see if they cover you for this.
